Here’s what we recommend for Florida residents with crypto holdings:
✅ Inventory of Digital Assets
Provide a clear, confidential list of:
• Coin/token names (e.g., Bitcoin, Ethereum)
• Quantity held
• Location: exchange, cold wallet, USB device, mobile wallet
✅ Access Information
This may include:
• Exchange login credentials
• Wallet passwords, PINs, seed phrases
• Passwords to phones, laptops, and two-factor authentication apps
• Backup recovery options and written protocols
✅ Appoint a Digital Executor
This is someone capable and comfortable managing digital assets—not just any family member. Make sure they understand wallets, exchanges, and the risks of mismanaging crypto.
✅ Keep It Private
Never include private keys or access codes in your will. Wills become public record during Florida probate. Instead, create a separate digital asset memorandum held with your estate planning attorney or secured in a private vault.
✅ Name a Backup
If your digital executor can’t serve, a successor should be named and trained. This is especially important for complex crypto holdings or large portfolios.
Not Just Bitcoin—Other Digital Assets You May Be Forgetting
While Bitcoin and Ethereum are most common, your digital estate may include:
• NFTs and metaverse real estate
• Online business income
• Password-protected brokerage platforms
• PayPal, Venmo, or Coinbase balances
• High-value domain names
• Revenue-generating social media accounts
• Email accounts used for 2FA (two-factor authentication)
Each of these requires legal planning and secure instructions for access.
